Harm reduction, or harm minimisation, refers to a range of pragmatic and compassionate public health policies designed to reduce the harmful consequences associated with drug use and other high risk activities . Many advocates argue that prohibitionist laws cause harm, because, for example, they oblige prostitutes to work in dangerous conditions and oblige drug users to obtain their drugs from unreliable criminal sources. This usually involves softening punishments on risky behaviour, assisting people to stop the behaviour and addressing the reasons people engage in such behaviour. I read that the most comprehensive study ever done on marijuana was initiated by Nixon, who intensified the drug prohibition and started the so-calle "War on Drugs" and that this study found that the constituionality of such a prohibition, especially by a simple act of congress and not a constitutional ammendment, as was needed for alcohol prohibition, was highly suspect. The report also stated that the congress and president had a duty to obey the constitution even without a court order to do so. So is this modern day prohibition even legal? If I were to argue this in front of a court I believe I could make a case for the control of chemicals that alter a person in the ways many street drugs do. One would have to be careful though as a misstep could conceivably affect prescription drugs as well. Although, I think the administering of prescription medication under a doctor's care could also be said to promote the general welfare.
